pandemic, bringing to an end a legal battle that lasted five years over the workers\u2019 rights.<\/p>\n<p>Federal Court Justice Michael Lee emphasized that the penalty was intended to serve as a <strong>\u201creal deterrence\u201d<\/strong> to companies tempted by the financial gains of violating employment laws.<\/p>\n<p>In August 2020, amidst lockdowns and border closures and before Covid-19 vaccines became widely available, Qantas decided to terminate these employees and outsource their roles. The Federal Court later ruled that despite the airline\u2019s claims of \u201ccommercial imperatives,\u201d its actions were illegal because they denied employees the right to collectively bargain or engage in industrial action. Qantas\u2019s attempt to appeal the decision was subsequently dismissed.<\/p>\n<p>Known as the <strong>&quot;Spirit of Australia,&quot;<\/strong> Qantas, which has operated for 104 years, has been working to restore its reputation after a series of setbacks in recent years, including the illegal layoffs, rising ticket prices, complaints over service quality, and the sale of seats on flights that were later canceled. Vanessa Hudson, who became Qantas CEO in 2023, has pledged to enhance customer satisfaction. She succeeded Alan Joyce, who resigned earlier than expected amid criticism about the airline\u2019s treatment of workers and passengers, despite delivering strong profits to shareholders.<\/p>\n<p>Qantas has accepted the court\u2019s ruling. CEO Vanessa Hudson expressed regret, saying, \u201cThe decision to outsource five years ago, particularly during such an uncertain time, caused genuine hardship for many of our former team and their families. We sincerely apologise to every one of the 1,820 ground handling employees and to their families who suffered as a result.\u201d She added that the airline has spent 18 months changing the way it operates and rebuilding trust, which remains the company\u2019s top priority.<\/p>\n<p>The court ordered the fine to be paid in two installments: AUD 50 million to the Transport Workers Union and AUD 40 million held for future compensation payments to the former employees. This penalty is in addition to a previous AUD 120 million compensation package agreed upon by Qantas last year.<\/p>\n<p>Anne Guirguis, a former Qantas employee who worked for 27 years cleaning aircraft before being laid off, called the ruling a victory for herself and all Australian workers. \u201cWe can close this chapter and move on now,\u201d she said outside the court.<\/p>\n<p>Michael Kaine, National Secretary of the Transport Workers Union, described the court\u2019s decision as a <strong>\u201cfinal win\u201d<\/strong> for the affected workers. He criticized Qantas for its initial indifference, stating, \u201cQantas was not sorry to workers when it illegally outsourced these workers, many finding out they&#8217;d lost their jobs over a loudspeaker in the lunch room.
